Vynix is an AI-powered content generation platform that enables users to create images, videos, audio, and other digital content using artificial intelligence. The Service includes:
- AI Content Generation: Create images, videos, and audio using various AI models
- Model Selection: Access to multiple AI providers and models with different capabilities
- Content Management: Store, organize, and manage your generated content in collections
- Credit System: Virtual currency used to pay for AI generations
- Social Features: Share content and participate in community features
The availability of specific features, AI models, and capabilities may vary and is subject to change without notice.
3. Account Registration and Security
3.1 Account Creation
To use Vynix, you must create an account using one of our supported authentication methods (Google, Apple, or X/Twitter). You agree to:
- Provide accurate and complete information during registration
- Maintain the accuracy of your account information
- Create only one account per person
- Not share your account credentials with others
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
We are not liable for any loss or damage arising from unauthorized access to your account.
3.3 Account Suspension and Termination
We may suspend or terminate your account at our discretion if you:
- Violate these Terms or our content policies
- Engage in fraudulent, abusive, or illegal activity
- Create multiple accounts to circumvent restrictions
- Fail to pay for purchased credits or subscriptions
4. Credit System and Payments
4.1 Credits
Vynix uses a credit-based system for AI generations:
- Credits are virtual currency used to pay for content generation
- New users receive starter credits upon account creation
- Additional credits can be earned through daily rewards, referrals, and achievements
- Credits can be purchased through in-app purchases
4.2 Credit Costs
Each AI generation consumes credits based on:
- The AI model used and its computational requirements
- Output duration (for video and audio content)
- Resolution and quality settings
Credit costs are displayed before confirming each generation.
4.3 Purchases and Refunds
- All purchases are processed through Apple App Store or Google Play Store
- Prices are displayed in your local currency and include applicable taxes
- Purchases are final and non-refundable except as required by law or app store policies
- Refund requests should be directed to the respective app store
4.4 Credit Expiration and Forfeiture
- Purchased credits do not expire as long as your account remains active
- Bonus credits (from referrals, daily rewards, promotions) may expire as specified
- Credits are forfeited upon account termination for Terms violations
- Credits cannot be transferred, sold, or exchanged for cash
5. User Content and Licenses
5.1 Your Content
"User Content" includes all content you submit to or create through the Service, including:
- Text prompts and descriptions
- Images, videos, or audio you upload
- Collections and organization you create
5.2 License to Us
By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to:
- Process, store, and display your content to provide the Service
- Use anonymized prompts and usage data to improve our AI models and Service
- Create backups and archives for operational purposes
This license is limited to what is necessary to provide and improve the Service.
5.3 Your Representations
You represent and warrant that:
- You own or have rights to all content you submit
- Your content does not infringe any third-party rights
- Your content complies with all applicable laws
- Your content does not violate our Prohibited Uses (Section 7)
6. AI Generated Content
6.1 Ownership of Generated Content
Subject to these Terms and applicable law:
- You own the AI-generated content you create using Vynix, to the extent permitted by law
- Ownership rights may be subject to limitations based on the AI models used and their respective licenses
- We do not claim ownership of content generated by you
6.2 Usage Rights
You may use AI-generated content for:
- Personal, non-commercial purposes
- Commercial purposes, subject to the licenses of the AI models used
- Sharing on social media and other platforms
Some AI models may have specific restrictions on commercial use. Please check the model information before using content commercially.
6.3 No Guarantees
We do not guarantee that AI-generated content:
- Will meet your specific requirements or expectations
- Will be unique, original, or non-infringing
- Is suitable for any particular purpose
- Will be available indefinitely
6.4 Content Responsibility
You are solely responsible for:
- Reviewing all AI-generated content before use
- Ensuring content is appropriate for your intended use
- Obtaining any necessary rights or permissions for commercial use
- Any consequences of using or distributing generated content
7. Prohibited Uses
You agree not to use Vynix to create, generate, or distribute content that:
7.1 Illegal Content
- Violates any applicable law or regulation
- Depicts child sexual abuse material (CSAM) or exploits minors in any way
- Promotes terrorism, violence, or illegal activities
- Facilitates fraud, scams, or financial crimes
7.2 Harmful Content
- Harasses, bullies, threatens, or intimidates others
- Creates non-consensual intimate imagery of real people
- Generates deceptive deepfakes intended to mislead or harm
- Promotes self-harm, suicide, or eating disorders
- Contains extreme violence, gore, or graphic content
7.3 Infringing Content
- Infringes copyrights, trademarks, or other intellectual property rights
- Impersonates individuals, brands, or organizations without authorization
- Violates privacy rights or misappropriates personal data
7.4 Service Abuse
You agree not to:
- Attempt to reverse engineer, decompile, or extract source code from the Service
- Use automated tools, bots, or scripts to access the Service
- Circumvent usage limits, security measures, or access controls
- Interfere with or disrupt the Service or servers

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal and commercial purposes as permitted by these Terms. This license does not include the right to:

- Reverse engineer or attempt to extract source code
- Remove or alter any proprietary notices
- Use our trademarks without prior written consent
8.3 Third-Party Content and Services
The Service integrates third-party AI models and services. These are subject to their respective terms and licenses. We are not responsible for third-party content or services.

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without compensation or attribution to you.
9. Disclaimers and Limitations

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AVAILABILITY.
9.2 No Guarantees
We do not guarantee that:
- The Service will be uninterrupted, error-free, or secure
- AI models will produce desired or accurate results
- Generated content will be suitable for any particular purpose
- Specific features or AI models will remain available
9.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COSMIC META AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, or goodwill
- Service interruptions or loss of content
- Unauthorized access to your account or data
- Any damages exceeding the amount you paid us in the past 12 months
9.4 Indemnification
You agree to indemnify and hold harmless Cosmic Meta and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your User Content or generated content
- Your violation of these Terms
- Your violation of any third-party rights
10. Termination
10.1 By You
You may terminate your account at any time by:

- Ceasing all use of the Service
10.2 By Us
We may terminate or suspend your account immediately, without prior notice, for:
- Violation of these Terms
- Suspected fraudulent or illegal activity
- Extended inactivity (after notice)
- Any other reason at our discretion with reasonable notice
10.3 Effects of Termination
Upon termination:
- Your license to use the Service immediately ends
- You lose access to your account and content
- Unused credits are forfeited (except where prohibited by law)
- We may delete your data after a reasonable period
- Provisions that should survive termination will remain in effect
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
Any disputes arising from these Terms or the Service shall be resolved through:

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cosmic Meta regarding the Service.
13.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
13.3 No Waiver
Our failure to enforce any provision of these Terms does not waive our right to enforce it in the future.
13.4 Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
